Drug testing on suspicion of impairment

When drug or alcohol impairment is suspected in the workplace, or after an accident or incident, the employer needs to act quickly and in a legally robust way. Provsvaret offers drug and alcohol testing for workplaces, with laboratory verification and medical review where needed.

  • Legally robust process

A chain of custody that holds up before the Labour Court (AD).

  • Laboratory verification

GC-MS/LC-MS-MS confirms results in 1–2 days.

  • MRO review

Cross-reactions and medical explanations are ruled out.

How to handle a suspicion correctly

  1. Document the observations

The line manager documents specific observations in writing: time, place, behaviour, witnesses. This is the foundation of a legally sound process.

  2. Remove from safety-critical duties

The employee is immediately removed from safety-critical work – on paid time. This is a work environment measure, not a punishment.

  3. Offer a test in line with the policy

The employee is offered a test in accordance with your communicated policy. A refusal is handled according to the policy's rules.

  4. Rapid test + laboratory verification

Immediate rapid test; positive results are sent to the laboratory for GC-MS/LC-MS-MS confirmation.

  5. MRO + follow-up meeting

An MRO physician reviews for medical explanations. A structured meeting follows a confirmed positive result – read our guide on action plans.

When for-cause testing is relevant

  • After an accident or incident

Drug and alcohol testing may be relevant after a workplace accident or incident, particularly in organisations where safety, the work environment or responsibility towards third parties carries significant weight.

  • When there are clear signs of impairment

For-cause testing may become relevant in the event of specific observations such as a smell of alcohol, unsteadiness, slurred speech, severely reduced capacity to work or clearly changed behaviour.

  • On return after rehabilitation

Testing can form part of a structured return-to-work programme after rehabilitation, with planned and clearly defined follow-up tests.

  • After safety-sensitive events

Testing may be justified when an event poses a risk to colleagues, customers, patients or other third parties, particularly in roles with high responsibility or safety-critical duties.

Quality and legal certainty

  • Written observation before testing
  • Informed consent at sampling
  • Legally robust chain of custody
  • GC-MS/LC-MS-MS confirmation
  • MRO review before reporting

If the result is confirmed positive

A structured action plan with confirmatory analysis, MRO review, a meeting with the employee and a rehabilitation assessment. Details in our guide: action plan after a positive drug test.

Specific observations of impairment: odour, unsteady gait, slurred speech, changed behaviour, reduced capacity to work – or following a specific incident or accident. A subjective feeling without documented observations is not sufficient.
